Terms of Use

The App provides educational history content and may include references to war, weapons, alcohol, political conflict, violence, death, and other historical events or themes. For this reason, the App may be rated 13+ on the App Store.

The App is intended for educational use by a general audience, but some content may not be appropriate for every user. Parents and guardians are encouraged to review the App and supervise use by younger users.

If you are under the age of majority in your state, province, or country, you may use the App only with permission and supervision from a parent or legal guardian.

We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information through the App, please contact us at digipine.apps@gmail.com.

The App provides educational history content for informational and learning purposes only. We work to make the content accurate and useful, but we do not guarantee that all information is complete, current, error-free, or suitable for every educational requirement.

The App is not a substitute for professional instruction, school curriculum, legal advice, historical scholarship, or academic review.

The App, including its original videos, text, graphics, layouts, designs, branding, software, and other materials, is owned by DigiPine or licensed to us.

Some images, graphics, icons, templates, fonts, audio, video, or other design assets may be licensed from third-party providers, including Canva or other asset providers. Those third-party assets remain owned by their respective owners and are used under applicable licenses.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial use only.

You do not receive ownership of the App or any content by downloading, purchasing, subscribing to, or using the App. You may not copy, extract, download, redistribute, resell, modify, or use any App content or third-party licensed assets separately from the App unless you have permission from the applicable rights owner.

We may make certain content available at no charge ("Free Content").

Subject to these Terms, you may view Free Content for personal, non-commercial purposes. You may share official App Store links, website links, or other official links we provide.

You may not download, copy, record, re-upload, mirror, redistribute, sell, modify, or create derivative works from Free Content unless we give written permission.

Some content may be available only through a paid purchase or subscription ("Premium Content").

Premium Content is for your personal, non-transferable use only. You may not share your access, provide your device or account access to others, record videos, copy content, download files, bypass access controls, redistribute content, publicly display content, or use Premium Content for commercial purposes.

We may add, remove, update, replace, or restrict Premium Content at any time.

Purchases and subscriptions are processed by Apple through Apple's In-App Purchase system.

If subscriptions are offered, they may automatically renew unless canceled through your Apple ID or App Store settings before the renewal date. Billing, renewal, cancellation, and refunds are managed by Apple, not DigiPine.

By making a purchase or starting a subscription, you also agree to Apple's applicable terms, payment rules, and App Store policies.

We cannot directly issue App Store refunds. Refund requests must be submitted through Apple.

You agree not to:

- Copy, record, download, reproduce, distribute, sell, lease, publicly display, or publicly perform App content without written permission.

- Share, transfer, or resell Premium access.

- Bypass, disable, or interfere with subscriptions, paywalls, access controls, security features, or usage restrictions.

- Scrape, extract, harvest, or collect video IDs, files, metadata, or other App content.

- Use bots, scripts, automation, or reverse engineering to access the App or its content.

- Modify, decompile, disassemble, reverse engineer, or attempt to extract source code from the App.

- Remove or alter copyright, trademark, attribution, watermark, or proprietary notices.

- Use the App or content for commercial training, resale, redistribution, or incorporation into another product without written permission.

- Use the App in a way that violates law, infringes rights, or harms the App, our users, or our services.

The App may not currently require a separate DigiPine account. Premium access is managed through Apple's systems.

We reserve the right to suspend, restrict, or terminate access to the App or content if we believe you have violated these Terms, misused the App, attempted to bypass payment, or abused Premium Content.

The App may use third-party services to provide app functionality, video delivery, payments, advertising, analytics, crash reporting, or other features. These may include Apple, Cloudflare, Google AdMob, Canva, and other service providers.

Your use of the App may also be subject to third-party terms and privacy policies. We are not responsible for third-party services, outages, policies, or content.

The App may display advertisements. Ads may be provided by third-party partners such as Google AdMob.

Ads may be contextual or personalized depending on your device settings, consent choices, age settings, and applicable law. You can manage certain ad preferences through your device settings.

Your use of the App is also governed by our Privacy Policy. Please review it to understand how information may be collected, used, and shared.

If these Terms conflict with the Privacy Policy regarding personal information, the Privacy Policy controls for that issue.

Our educational videos are not generated by AI.

We may use AI-assisted tools to help improve text clarity, formatting, development workflows, user interface content, or other supporting parts of the App. AI-assisted tools do not replace our responsibility for the App and its content.

We may update, modify, suspend, remove, or discontinue any part of the App at any time, including features, videos, Free Content, Premium Content, pricing, or availability.

Some features may require an internet connection, compatible device, supported operating system, active subscription, or updated App version.

We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.

If you downloaded the App from Apple's App Store, your use of the App is also subject to Apple's applicable terms, including Apple's Standard End User License Agreement unless a custom license applies.

Apple is not responsible for the App's content, support, warranties, claims, or legal compliance except as required by applicable law.

Please include:

- Your name and contact information.

- A description of the copyrighted work or rights you believe are infringed.

- A description of where the content appears in the App.

- A statement that you have a good-faith belief the use is not authorized.

- Any other information that helps us review the issue.

We may remove content or restrict access when appropriate.

The App and all content are provided "as is" and "as available."

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and uninterrupted operation.

To the fullest extent permitted by law, DigiPine and its owner, developers, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the App.

This includes damages related to loss of data, lost profits, lost access, service interruptions, content errors, subscription issues, or third-party services.

You agree to defend, indemnify, and hold harmless DigiPine, its owner, developers, contractors, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the App, violation of these Terms, violation of law, or infringement of another person's rights.

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above.

Where appropriate, we may notify you in the App or by other reasonable means. Your continued use of the App after updated Terms are posted or presented means you accept the updated Terms.

These Terms are governed by the laws of the State of Oregon, excluding its conflict of law rules, unless applicable law requires otherwise.
